Semi-truck pins vehicle against retaining wall in Tennessee

When a truck driver or truck company fails to exercise due care, the results can be devastating. In legal terminology, failing to exercise due care is often termed negligence. Truck drivers can display negligence in a variety of ways -- for example, by driving too many hours without adequate rest or making illegal turns or maneuvers. A Tennessee Highway Patrol Trooper cited a truck driver on a charge of failing to exercise due care. The charge is being levied after an accident between the tractor-trailer and another vehicle. The tractor-trailer sideswiped the other vehicle, resulting in a man being pinned between the truck and a retaining wall. Traffic on the Tennessee highway where the accident occurred was stalled in both directions.

According to reports, the man was trapped in his vehicle for nearly an hour. Rescuers had to use the Jaws of Life and a metal cutting tool to cut through the vehicle's roof and retrieve the man from the wreckage. The man was rushed to a nearby hospital where he was treated for non-life-threatening injuries.

Truck drivers, truck companies and their insurers can be held accountable for any actions that fall under the label of negligence. Because of their immense size and weight, tractor-trailers pose a threat to all other vehicles of less size on the road. This is why there are state and federal trucking regulations that truckers and truck companies are expected to abide by in order to prevent truck accidents from occurring. When these are violated, victims can oftentimes build a strong legal strategy and pursue compensation for the injuries they have suffered.
