The law does not treat motorcyclists differently

In many cases of motorcycle accidents, people tend to engage in some form of victim-blaming toward the motorcyclist. Whether it is the media reporting that the driver was not wearing a helmet or members of the community talking about how motorcycles are dangerous to begin with, and people should consider such dangers when riding, there is often a sense that the motorcyclist is somehow responsible for his or her own serious or fatal injuries. The good news is that the law suffers from no such prejudices.

When it comes to the law, motorcyclists have very clearly defined rights on the road. When those rights are infringed upon, leading to accident and injury, the motorcyclist can take legal action to be compensated for any health issues suffered as a result of the accident. In nearly every case of motorcycle accidents, it does not matter if the biker was wearing a helmet or if the biker was aware of the dangers. What matters is whether or not the rules of the road were being obeyed and by whom.

If a motorcycle accident occurs, and the motorcyclist can prove that another driver was at fault, then the odds are that the motorcyclist will be able to recover compensation for his or her injuries. Unfortunately, with some motorcycle accidents, the victims are not able to take legal action on their own behalf, either because the injuries were fatal, or they were so severe that the victim is in a coma or other such invalid state. In such cases, members of the victim's family should know that they can pursue legal action on their loved one's behalf.

You should not be made to feel like you are in the wrong simply for riding a motorcycle. If you enjoy riding a motorcycle, then you are perfectly within your rights to do so, and you should not have to be afraid that others will treat you with disrespect on the road. If you have been injured in a motorcycle accident in Tennessee, and you know that you were not at fault, then you are encouraged to pursue legal action to be compensated by those who injured you.
