Understanding defects in design

Generally speaking, defects in design are directly related to the way a manufacturer produces a product.

As a consumer, you believe that everything you purchase is safe. Unfortunately, this is not always the case. There are times when a dangerous product makes its way to market, thus putting consumers in a difficult spot.

There are many types of defects in design, which is why it can be so difficult to pinpoint when a company was in the wrong. In the event that a person was injured by a product, he or she may be able to demonstrate that a design defect caused the injury. In order to be successful, the plaintiff must be able to prove that an alternative design could have prevented the injury.

Consumers don't typically have much knowledge of the design and manufacturing process, which is why they don't know if they are buying a product that is safe. Instead, they assume that the company and manufacturer did their job in producing something that is safe when used in the intended manner.

If a person is injured as the result of using a product, it's imperative to first receive medical attention. From there, it's important to review the product, including its design, to determine if there was a defect.

Just because somebody was injured by a product does not mean it was defective, but this is always a possibility. This is why it's important to review your situation in great detail. You may find that you are in position to file a claim against the manufacturer and/or another negligent party.
