Why should I keep my medical records after an accident? | Bart Durham Injury Law

Why should I keep my medical records after an accident?

After an auto accident, you may not want to organize the mountain of paperwork it can generate. However, keeping track of all your medical records after a wreck is one of the most important things you can do.

Medical records are needed to begin an auto injury case. If you are still in pain weeks or months after an accident, these records can help document this for legal action. Any doctor's appointments, physical therapy sessions, or prescribed pain medication that were a result of an auto accident should be documented.

These medical records can help prove someone's negligence caused you extensive pain and suffering, as well as show the financial burden these courses of treatment created. If you weren't responsible for the accident, why should you be responsible for paying for these bills?

Did you know in the state of Tennessee, you can file a lawsuit to try and reach a settlement at any time within one year of the accident? This is called the statute of limitations. A statute of limitations is essentially a time limit by which a victim of a crime or incident may file a lawsuit. Of course, there are exceptions, but only rarely.

Medical records are used in a legal case to help establish proof. Due to HIPPA privacy laws, you will need to waive medical privacy rights with an insurer should they want to investigate your claim. To make sure you are being fairly represented, you should consult with an attorney to help make sure you are sharing the correct information for your case.

Keeping track of medical paperwork and records can be stressful. Having an attorney making sure you are doing so properly can make the difference between receiving a settlement or not. For help regarding your case, feel free to call Bart Durham Injury Law at 615-242-9000. The consultation is free and you pay nothing until they win your case.
